Welcome to RealVOTalent. These Terms of Service govern your use of our platform. By accessing or using RealVOTalent, you agree to be bound by these terms.

1Acceptance of Terms

By creating an account or using any part of the RealVOTalent platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services. These terms constitute a legally binding agreement between you and Trevor O'Hare Productions LLC ("RealVOTalent," "we," "us," or "our").

2Eligibility

To use RealVOTalent, you must meet the following requirements:

  • •You must be at least 18 years of age
  • •You must have the legal capacity to enter into a binding agreement
  • •You must not be prohibited from using our services under applicable law
  • •All information you provide must be accurate and complete

3Account Responsibilities

When you create an account with RealVOTalent, you agree to:

  • •Maintain the security and confidentiality of your login credentials
  • •Notify us immediately of any unauthorized access to your account
  • •Maintain only one account per person
  • •Keep your account information accurate and up to date
  • •Accept responsibility for all activities that occur under your account

4Platform Description

RealVOTalent is a marketplace platform that connects clients seeking voiceover services with professional voice talent. We facilitate the discovery, hiring, and payment process between parties but are not a party to the agreements made between clients and talent. RealVOTalent does not employ voice talent directly; all talent are independent contractors responsible for their own work product and tax obligations.

5User Roles & Obligations

For Clients:

  • •Provide clear, complete project briefs and scripts
  • •Make timely payments for accepted work
  • •Communicate professionally and respectfully with talent
  • •Review and approve deliverables within a reasonable timeframe

For Talent:

  • •Deliver high-quality work that meets project specifications
  • •Meet agreed-upon deadlines
  • •Maintain accurate profile information and demo samples
  • •Communicate professionally with clients
  • •Honor revision requests per our revision policy

6Payments & Fees

  • •All payments are processed securely through Stripe
  • •Client payments are held in escrow until project completion
  • •RealVOTalent charges a platform fee for facilitating transactions
  • •Talent payouts are processed after project approval
  • •All fees and pricing are displayed before transaction confirmation

7Cancellations & Refunds

  • •Before delivery: Clients may cancel and receive a full refund if the talent has not yet delivered work
  • •After delivery: Refunds are generally not available once work has been delivered
  • •Disputes will be reviewed on a case-by-case basis
  • •See our Satisfaction Guarantee for additional protections

8Intellectual Property

  • •Voice recordings: Intellectual property rights for completed voiceover work are negotiated between client and talent on a per-job basis
  • •Platform content: The RealVOTalent name, logo, and platform design are owned by Trevor O'Hare Productions LLC
  • •Demo samples: Talent retain rights to their demo recordings
  • •Users may not reproduce, distribute, or create derivative works of platform content without permission

9Voice Data Protection & AI Restrictions

RealVOTalent is committed to protecting the vocal identity and personal data of our voice talent. In alignment with the NAVA fAIr Voices Principles, the following policies apply to all users of the platform, including clients, talent, and any third parties who access voice recordings or related data through RealVOTalent. These policies encompass the use of artificial intelligence, machine learning, data set training, and/or voice cloning and synthesis.

9a. Training

  • •You may not use any voice recordings, audio samples, demos, auditions, deliverables, or other sound files obtained through RealVOTalent to create, develop, train, fine-tune, or otherwise build synthetic voice models, voice clones, or text-to-speech (TTS) systems using artificial intelligence, machine learning, deep learning, or any related technology
  • •You may not collect, scrape, aggregate, or otherwise harvest voice data, metadata, vocal characteristics, or biometric voice information from the platform for the purpose of training or improving AI or machine learning models of any kind
  • •You may not transfer, license, share, sell, or otherwise provide voice recordings or related data obtained through RealVOTalent to any third party for the purpose of synthetic voice generation, AI training, or machine learning development

9b. Consent

  • •All users of RealVOTalent's services have the right to actively consent to the use of their voice, image, name, and/or likeness for the creation, training, and modeling of synthetic voice models, digital clones, and replicas created using AI and/or machine learning. This includes, but is not limited to, the use of sound files, video, or other media containing a user's biometric data
  • •You may not use any technology to replicate, simulate, or synthesize a voice talent's vocal identity, likeness, or performance style without that talent's explicit, written, and informed consent obtained independently of this platform
  • •Any use of a voice talent's recordings beyond the scope of the original project agreement requires separate, explicit written consent from the talent. This includes, but is not limited to, any AI-related or synthetic voice application

9c. Control

  • •All users of RealVOTalent's services have reasonable control of the work created using their voice, image, name, and likeness
  • •If a synthetic voice model or digital double is created with a talent's consent, the talent retains reasonable control over the types of work that can be generated by their synthetic voice model, digital clone, or replica. This control may be project-specific, and the parameters of this control must be decided upon in advance of any such use
  • •Talent may revoke consent for future synthetic voice use at any time by providing written notice to RealVOTalent and/or the client, subject to any existing contractual obligations for work already in progress

9d. Compensation

  • •All users shall be fairly compensated, according to a mutually agreed upon rate and rate structure, if a company or client wishes to use their voice or sound files for the creation, training, and modeling of synthetic voice models created using AI and/or machine learning
  • •Compensation terms for any authorized AI or synthetic voice use must be established in a separate written agreement prior to such use, and may reference industry standard rates from SAG-AFTRA, GVAA, or other widely accepted rate guides applicable to the talent's location

9e. Security

  • •RealVOTalent agrees to use good faith efforts to prevent any files of recordings or performances stored in digital format containing a user's voice or likeness from unauthorized access by third parties
  • •Where such files are stored in cloud-based services, RealVOTalent utilizes services that offer safeguards through encryption and other up-to-date technological means to protect against unauthorized third-party access
  • •Clients who receive deliverables through the platform are likewise expected to take reasonable measures to secure voice recordings and prevent unauthorized access or misuse

9f. Sourcing

  • •RealVOTalent agrees that all files used for the training and creation of synthetic voice models created using AI and/or machine learning will be fairly sourced, with the active consent and knowledge of the person the files are sourced from
  • •RealVOTalent does not and will not use any voice recordings, demos, auditions, or deliverables hosted on or transmitted through the platform for AI training, synthetic voice creation, or any machine learning purpose

Enforcement: Violation of this section constitutes a material breach of these Terms of Service and may result in immediate account termination, legal action, and liability for damages including statutory damages where applicable. RealVOTalent reserves the right to pursue all available legal remedies, including injunctive relief, against any party that violates these protections. These obligations survive termination of your account and any project agreements.

10Prohibited Conduct

Users may not engage in the following activities:

  • •Circumventing the platform to avoid fees (e.g., arranging off-platform payments)
  • •Harassment, abuse, or discrimination toward other users
  • •Fraudulent activity or misrepresentation
  • •Uploading malicious software or spam
  • •Violating intellectual property rights of others
  • •Using voice recordings or data to create AI-generated or synthetic voices (see Section 9)
  • •Using the platform for illegal purposes

11Dispute Resolution

Any disputes arising from or relating to these Terms of Service or your use of RealVOTalent shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. By using RealVOTalent, you agree to waive your right to participate in class action lawsuits or class-wide arbitration.

Before initiating arbitration, you agree to first contact us at admin@realvotalent.com to attempt to resolve the dispute informally.

12Limitation of Liability

To the maximum extent permitted by law, RealVOTalent and Trevor O'Hare Productions LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities. Our total liability for any claims arising from your use of the platform shall not exceed the fees you paid to RealVOTalent in the twelve (12) months preceding the claim. RealVOTalent is provided "as is" without warranties of any kind, express or implied.

13Termination

  • •You may close your account at any time by contacting us
  • •We reserve the right to suspend or terminate accounts that violate these terms
  • •Upon termination, your right to use the platform ceases immediately
  • •Outstanding payment obligations survive termination

14Changes to Terms

We may update these Terms of Service from time to time. When we make changes, we will update the "Last updated" date at the top of this page. Continued use of RealVOTalent after changes are posted constitutes acceptance of the revised terms. We encourage you to review these terms periodically.

15Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Important: These Terms of Service are a binding legal agreement. By using RealVOTalent, you acknowledge that you have read and understood these terms. If you have questions about any provision, please contact us before using the platform.
